Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your purchase and use of Gymbly products. By purchasing, downloading or using any Gymbly product you agree to these Terms. If you do not agree, do not purchase or use the product.

2. The products

Gymbly sells digital products, including white-label fitness app source code, templates, documentation and related files ("Products"). Products are delivered as digital downloads. Because they are delivered instantly, all sales are final except as described in our Refund Policy.

3. License

When you purchase a Product, you receive a non-exclusive, non-transferable license to use it according to the plan you purchased:

• Starter: one license for one app that you own and operate.
• Pro: unlimited white-label licenses, so you can resell apps to your own clients as your own product.

You may not resell, redistribute or share the raw source code as a template, theme or digital product of your own, except as part of a finished app delivered under the Pro license.

4. Payments and pricing

All prices are in US dollars unless stated otherwise. Payment is processed by our payment provider. Prices may change at any time, but changes do not affect purchases already made.

5. Refunds

Because Gymbly sells digital products, refunds are issued only when the Product is defective or does not work as described, or when you were charged in error. See the full Refund Policy.

6. Your responsibilities

You are responsible for your own servers, domains, hosting, app-store accounts and any third-party services you connect to the Product. Gymbly is not responsible for issues caused by third-party providers.

7. Updates

Starter includes 12 months of updates. Pro includes lifetime updates. Updates are provided as available; we are not obligated to release specific features or a fixed number of updates.

8. No warranty

Products are provided "as is" and "as available" without warranty of any kind, express or implied, including fitness for a particular purpose. We do not guarantee that the Product will meet your specific business needs.

9. Limitation of liability

To the maximum extent permitted by law, Gymbly's total liability arising from a Product is limited to the amount you paid for that Product. We are not liable for indirect, incidental or consequential damages, including lost profits.
